TERMS AND CONDITIONS

1. General Terms

1. STUDIO Translations performs translation of all texts from/into English as requested by the Client.

1.2 General pricing of the agency refers to translation of standard texts. Standard texts include all types of general text and specialist texts, which are mainly for the informative purposes. Standard texts may not cover literary, religious, culture and arts, advertising and legal texts, or any other texts where – content aside –the form is also an important conveyor of meaning. Such form may be represented by i.e. sophisticated stylistics, linguistic ornamentation, archaisms, slogans etc. Advertising slogans can serve here as an example, as they require a special approach to translation, or also certain legal and official documents (e.g. patent specifications) which pose additional difficulty due to their extensive and complex stylistics.

1.3 The Agency may refuse to translate any text which expresses vulgarity or violates any person’s good name, or gives a reason to assume violation of a third party’s rights.

1.4 The Agency disclaims liability for any third party damage arising from translation performed by the Agency.

1.5 The Agency does not perform any translation ad hoc at the Client’s premises, nor any rough or summary translation of the texts delivered by the Client.

1.6 The Agency refuses consent for providing its work to other translators or translation agencies for any modification (proofreading, supplementation, etc.) without its knowledge and written consent.

1.7 The translation includes basic editing of the text and print of one copy, which is covered under the standard pricing.

1.8 Complex formatting of translated work, as well as input of graphic elements (tables, illustrations, photographs, etc) is treated as additional work and therefore subject to additional charge.

1.9 The Agency must be notified of the intent to share or transfer the work translated by the Agency to third parties or use it in any other way with material benefit to the Client (e.g. publishing, resale, etc.), so as to seek the Agency’s consent – in line with the Copyright Act of 4 February 1994 (Journal of Laws, no. 24, item 83). The Client shall conclude an agreement with the Agency in relation to the Agency’s share in profits arising from the copyright. The Client will be obliged to fully respect the concluded agreement and to notify the Agency of all the benefits obtained due to sharing or transferring its Translations. The Agency will not claim copyright if the published translations of the Agency are scientific articles.

1.11 The Agency recognises all the materials provided for translation by the Client as holding a regulated copyright status, which enables their translation by the Agency without imposing on any third party right to those materials. The Client shall protect and defend the Agency against any third party claims due to violation of their right to the materials requested for translation by the Client, arising from translation by the Agency.

1.12 All the instructions and guidelines provided by the Client (such as requesting specific vocabulary to be used, common names, etc.) referring to the ordered translation should be provided by the Client in writing along with the copy of the order.

2. Translation Standards

2.1 The mode of translation is determined based on the text’s specification and the required deadline, provided by the Client in their quote enquiry.

2.2 The basic unit of the translated text is 1 page = 1800 characters including spaces of the target text. The number of characters is calculated by the text editor. In the case of certified translation, 1 page = 1200 characters including spaces.

2.3 The mode for translation requested within the same working day is accepted as urgent (standard price + 25%). In the case of particular urgency of the translation or non-standard time of performance (in the evening, during holidays, etc.), the Agency reserves the right to charge the express translation rates (standard price + 50%).

3. Pricing

3.1 Prices listed in price lists refer to one page (as in p.2.2) of the translated standard text (as in p.1.2) including standard editing.

3.2 The Agency also reserves the right to add extra charges due to arduousness of the text. The text is considered arduous in the following cases:

a) poor linguistic quality causing ambiguity or difficulties in understanding (e.g. texts written by a person who is not a native of the given language);

b) poor print quality (poor handwriting or print, very small print, etc.)

The Agency reserves the right to omit the paragraphs, which are hard to read/comprehend as in a) and b) above.

3.3 The Agency reserves the right to price translation, which is particular in terms of time consumption or arduousness according to the hourly rate.

3.4 The additional costs of translation and/or editing of the material requested for translation, if any, shall be specified individually and provided to the Client in reply to their enquiry for a quote or in the order confirmation.

4. Confidentiality

4.1 The Agency considers all the materials and information provided by the Client confidential and hence it protects them accordingly.

4.2 The Client is obliged to protect accordingly all the confidential material and information provided by the Agency. In particular, the Client shall not provide them to any other translation agencies or individual translators.

5. Complaints

5.1 Any complaints about the performed translation should be delivered within 7 days from the date of receipt of the translated work. Complaints should be concise and to the point and should refer exclusively to the problem at issue. They should be presented in writing, in the form of a separate note or overwriting the translated text in a clear manner (an electronic version is permitted). The Agency disclaims liability for discrepancies arising from incompleteness, poor level of readability or content of the text provided for translation (e.g. non original text), or for the failure to follow the Client’s guidelines/instructions, if they have not been delivered in writing along with the order. Complaints shall be processed by the Agency only after the Client has settled in full the invoice issued by the Agency. Any mistakes and errors arising from the exclusive fault of the Agency shall be immediately addressed by the Agency at its cost.
